This website is operated by CakesNearMe.in (“CakesNearMe”, “we”, “our”, “us”). By accessing the site and/or placing an order, you agree to these Terms & Conditions.

1) Order Acceptance

  • An order is accepted only after successful payment authorization (for prepaid) or explicit confirmation (for COD, if offered in your PIN code).
  • We may refuse/cancel any order due to address/serviceability issues, suspected fraud, inventory constraints, or pricing errors. If payment was captured, you’ll receive a full refund of the amount paid.
  • Order changes (address, slot, message, product) after confirmation are subject to approval and feasibility.

2) Delivery & Serviceability

  • Delivery slots are estimates, not guarantees. Delays may occur due to traffic, weather, local restrictions, peak seasons, or safety checks.
  • If a specific variant isn’t available, we may substitute flowers, fillers, decorations, or packaging with equal or higher value while preserving the overall look and sentiment.
  • Customer responsibility: provide accurate recipient name, complete address, PIN code, and reachable phone number.
  • If the recipient is unavailable, premises closed, or phone unreachable, we may attempt delivery with the available slot constraints. Re-delivery (if possible) may incur an additional fee.
  • We don’t deliver to restricted areas where local rules prohibit entry. In such cases, we’ll contact you for alternatives.

3) Pricing, Taxes & Payments

  • Prices are shown in INR and include applicable taxes unless stated otherwise.
  • Accepted methods: UPI, Cards, NetBanking, Wallets, and COD (where offered).
  • Orders are processed only after full payment (prepaid). For COD, exact cash or supported digital payment at delivery may be required.
  • We reserve the right to correct pricing/stock errors. If the corrected information is unacceptable, we’ll cancel and refund the payment.

4) Cancellations, Returns & Refunds (Summary)

  • Perishables (cakes/flowers) and time-sensitive deliveries (same-day/early-morning/midnight) follow stricter rules.
  • For complete details, refer to our Cancellation Policy and Refund & Return Policy (both form part of these Terms).
  • Where refunds apply, they’re processed to the original payment method (COD refunds as Wallet Credit, if applicable).

5) Product Images, Customization & Variations

  • Product photos are representational. Minor variations in color/design due to seasonal availability, regional sourcing, or monitor settings are normal.
  • Customized/personalized items (e.g., photo cakes, printed mugs) are produced as per your inputs; please review text/images carefully before submitting.

6) User Responsibilities

  • You confirm you’re 18+ and legally capable of entering into a contract.
  • You’ll not use the site for fraudulent, abusive, or unlawful purposes, or interfere with site operations.
  • Information you submit (reviews, messages) must be accurate and not infringe third-party rights.

7) Communications & Consent

  • You consent to receive transactional communications (order updates, OTPs) via email/SMS/WhatsApp.
  • Promotional messages are sent only with consent/legitimate interest; you may unsubscribe anytime.

8) Intellectual Property

  • All content, including text, images, logos, product data, and site design, is the property of CakesNearMe or its licensors.
  • You may not copy, reuse, modify, or distribute content without our written permission.

9) Limitation of Liability

  • To the fullest extent permitted by law, we’re not liable for indirect, incidental, or consequential losses (including delays, substitutions, or service interruptions).
  • Our total liability for any claim related to an order is capped at the amount you paid for that order.

10) Indemnity

  • You agree to indemnify and hold harmless CakesNearMe, its affiliates, and staff from claims arising out of your misuse of the site, violation of these Terms, or infringement of third-party rights.

11) Force Majeure

  • We aren’t responsible for delays/failures caused by events beyond our control (e.g., extreme weather, strikes, lockdowns, network outages, government actions).

12) Privacy

  • Your use of the site is also governed by our Privacy Policy (how we collect, use, and protect data).

13) Governing Law & Dispute Resolution

  • These Terms are governed by the laws of India.
  • Subject to applicable law, courts at New Delhi, India shall have exclusive jurisdiction.

14) Changes to Terms

  • We may update these Terms at any time. Continued use of the site after changes means you accept the updated Terms. The latest version will always be available on this page.
